Investigating David Kernell
At this point, all we know about the University of Tennessee student who is rumored to be the subject of an investigation into the Governor Sarah Palin email hack-attack is that he is the son of State Representative Mike Kernell (D) from Memphis. WBIR is reporting:
The son of state Rep. Mike Kernell has been contacted by authorities in connection with a probe into the hacking of personal e-mail of vice presidential candidate Sarah Palin, Kernell confirmed on Thursday.
To be CLEAR, at this point no charges have been filed. At this point, we only have confirmation of contact by the authorities.
But…if David Kernell is the young man responsible for the hack-attack, here are some screenshots of David Kernell’s facebook sent to me from some UT college students who don’t wish to be identified. Note, I edited the 2nd page by taking a new shot of the entire screenshot in order to avoid publishing his mobile phone number.

UPDATE WED, OCT 8: WBIR is reporting that Kernell was shackled and cuffed and has provisions with his release:
When he arrived at court, he was shackled and handcufffed.
The conditions for his release contain more than a dozen provisions, including:
–cannot leave the Eastern District of Tennessee without court permission. Kernell’s family lives in Memphis.
–cannot possess a computer.
–can access e-mail and can only access internet for class work.
–must not have any contact with Gov. Sarah Palin or her family.

I’m not providing the information because Mr. Kernell proved what happens when you release information that’s not intended to be released. But, if you know a UT student who is willing to log in to their account and look up Mr. Kernell, you will find his (901) phone number. I assume that’s a cell. perhaps it is also in last year’s student directory, too. I just have my own reasons why I won’t publish it but I encourage anyone who can get access to it, to enjoy away

If the shoe had been on the Repub side, this would have been posted all over every TV station in the world, the web from front to back, they would have sent out a team of investigators to find out if the MCCain Camp was behind it. About 3 days ago I posted observations about a Technorati search I did for “david kernell”.
The original screen shot I made of the results showed a Video of David Plouffe, and 3 other video’s (without caption names) between Search results. Later when I did the same search there were no images in the search results. The images could only be viewed by clicking on the gray video tab behind the search result screen. (which had caption names)
There were comments posted on this forum that the word “David” was the common element of images that were “about David Kernell”. After looking at the results, this is probably the correct explanation.
Although I still think young David Kernell took seriously the comments of the Ploofe video that they were the “cavalry” of the Obama campaign.
Now the strangest part. For a time yesterday, the image of David Plouffe would not show up at all on the search, but would still show up if you searched for “David Plouffe”. There was a time that there were no results at all from search for “david kernell”. But the strangest part happened last night after a phone conversation with Erick, I e-mailed him my screen shot to help us discuss this. It just dissappeared. Finally I e-mailed him the screenshot via another mail address that I use, it worked fine. Today I received a notification from my local ISP e-mail administrator: “WARNING. Mail Delayed: testing outgoing e-mail” This is a warning message only.
Your message remains in the server queue,
the server will try to send it again.
You should not try to resend your message now.
My e-mail attachment had been filtered. I tested it with other messages from my back-up e-mail account and it worked fine both directions.

As of last night, the Feds still hadn’t contacted Mike or David Kernell.
Neither of them are working with Obama’s campaign.
IF David did so this, it certainly had nothing to do with his father, no more than Palin’s 19 yr old son’s drug addiction or her under age daughter’s pregnancy had to do with her.
I can’t speak for David, because I don’t know him. But I do know his father’s integrity is beyond reproach.
Children of GOOD parents do Bad things on both sides. Let’s not politicize this. IF David did something wrong, he’ll be held accountable, but whatever he did or didn’t do, the Feds clearly aren’t worried about it or they would have at least talked to him by now.

In the wake of hacking the Yahoo! e-mail account of Vice Presidential candidate Sarah Palin, Web sleuths and the Feds may have nabbed the perpetrator. Meanwhile, Associated Press reporters were apparently in e-mail conversation with the suspect even as authorities were attempting to track him down.
According to reports in Knoxville’s Tennessean, Democrat State Representative Mike Kernell admitted that his son, David Kernell is being questioned by authorities in connection with the crime. The Secret Service and the FBI launched an official investigation on September 17.
Sounds like they are talking to somebody even if they are not talking to you.

I was linked here inderectly, so I don’t have any form of context as to the sort of site this is, I was just trying to keep up with the story.
I only breezed through the comments, so if they changed tone by the bottom of it, I did not notice it. But I did notice a lot of theories speculating connections between kernell and the obama campaign. These are purely coincidental.
It’s already known that this was not a deliberate, nor thought out attack against mccain or any part of his campaign. though kernell may dislike both mccain and palin, the main drive behind this action was of joking nature.
and to the word “hacking,” i don’t think that truly describes the occurance. This was not a well protected government account, it was yahoo. the chances are kernell was either able to guess her password, or, after reading one of the multitude of articles about her, was able to guess the answer to one of her security questions.
what i think is more important than the intent and affiliation of kernell, though, is the fact that this was a personal account. kernell was arrested after 5 days. if the personal account of a typical citizen in the united states were hacked, they would expect no retribution. i’m personally disgusted that it would be expected that the potential future vice president would not get the same treatment for hers.

Anyone who thinks that because the Feds have not done anything yet, that this is minor or that they are not going to, should stick to talking about what they know about. I DO know about the Fed and the Fed’s actions – and they like to gather up all of the evidence they can in situations like this and THEN hit the perp really, really hard with charges that stick.
I also have a feeling that David is going to be REAL popular in his new “dorm” with the various Bubba’s tag-teaming on him. His soft skin and high pitched squeals ought to set off a feeding frenzy with the long term residents. He’s better “bone-up” on some stretching exercises so that he’s not all tore up and useless in just a couple of days.

I know David, as well. As far as his motives, I’ll put money on the fact that this was unplanned and probably spur of the moment. I can picture him playing around on the internet and acting on an idea without thinking of the consequences. He’s a typical college student, but he is very passionate about his political views. I am certain that this was of his own accord, and he is not involved in any crazy secret activity. This was a strong-willed student going too far without considering the future.

Leah–Just from the bragging comments posted on the web and the fact that the perp knew he would be in big trouble if anyone found out, leads me to believe he probably did this on his own.
But I want to know if he told anyone else, emailed anyone else, called anyone else and either a) let them know what he was doing b) gave or sent them the emails. If so, were any of those folks involved in any official capacity either with Obama or the Dem. Party.
Just from his web comments, the perp clearly knew up front what he was doing was an invasion of privacy. And though folks are trying to distract from the crime with arguments about the ease at which he hacked her account, the reality is, he knew and he surfed and he published.
I would suggest all those who claim it wasn’t hacking to surrender their own passwords so we can all go snooping through their accounts as well.
As far as playing around on the net, I think at 20 he knew very well what he was doing. He was doing what got Obama to the U.S. Senate, snooping into the personal lives of the opposition.
No doubt, he was hoping to make his leader proud. And believe me, if he had found something incriminating, we’d all be talking about it and the privacy issue would only be a footnote.

i agree. I think he should be held fully accountable. But at the same time I think that it should be taken into account the seriousness of what happened. as a joke, a kid answered the security question to someone’s email address. he then went on to post a few pictures and a contacts list on the internet. Yes, it’s an invasion of privacy. But as far as they go, this was minor, at best. Thousands of 15-25 internet users would have done the exact same thing had the thought dawned on them.
I think that the involvement of any authority in this situation is an abuse of power, and I believe that if Kellner receives anything more than a slap on the wrist he will be the only victim at the end of it.

David Kernell in his own words over the 4chan.org forum amoung the /b/-tards gave it away. He expressed dissapointment that he didn’t find some dirt. That is was just common family converstion and pictures. He intended to break into her e-mail account to get the goods. To help whom? It did nothing for him, but who would it help to get the goods on Sarah Palin. None other than Barrack Obama.
This is all pointless. It is probably better that we wait for the Fed’s to finish the job. They are on this, and I have seen direct evidence of their presence. They don’t want this to go viral and complicate the legal side of persuing this. It is out of our hands to influence this at all now.
Eventually the press will be given information that they will reluctantly release. They have done everything in their power to surpress all knowledge of this. You can see it even on this forum. We had one of them try to pass herself off as a friend of Mike Kernell.

I’m sure you are trying to stick up for friend, and keep your own integrity, but you made an unfair, false smear of Track Palin. He did not join the Army because of drug addiction, and I’m shocked you would spread that around as if it were conventional wisdom.
And I believe it is David Kernell who politicized his own acts by asserting that he took his actions in concert (with a bunch of other persons) to bring down her candidacy – he was sure her stored emails would contain damning evidence of some recently publicized assertions that she “hid” mail from subpoena. Embarrassment to Palin and lulz would be gravy.
Whether he deserves is or not, Mike Kernell will share a portion of, if not blame, (since these are his son’s acts and not his own) the disgrace of having raised an adult with criminal disregard for the rights of others and the law.
That is a failure indeed, the biggest failure there is in life. A pregnancy is not such a crime, and Palin’s son has put his own life in harm’s way for all of us.
I do not think the situations compare. FWIW I don’t think in Palin’s case, that she has nothing to do with how her children turn out, or how they handle the errors they do make.
I don’t decide who governs me based on parenting success or failure, either. Mike Kernell may be an excellent legislator or even an excellent friend. But he will have a cloud of this disgrace to deal with, however blameless he might be.
His son has, by his own account, been depressed and institutionalized….and it appears to be related in part to family issues.

Malicious breaking into web-based email is not something I want any idiot to feel he can indulge in at whim.
Worse, he bragged about it, posted the email password so that others could alter the contents of the account and spread confidential addresses and private pictures.

Just because this kid is being investigated, does not mean he did it.
I find the theories, and invasion of his facebook account, and publication of his personal information, to be humiliating for this kid.
Just because he is being investigated, does not mean he really did it. If you knew anything about hacking, you would know that networks are not secure and that it is possible to ’spoof’ IP addresses.
And, if it turns out that he did, can you legally claim that it is ok to display his private information all over the internet?
You are just as culpable as the perpetrator who got into Palin’s email account, regardless of innocence or guilt.

Perhaps it is me, yet I feel as if people are allowing their opinions to get in the way of the actual legal process.
I always thought that the American people desired a system that held one innocent until proven guilty. Yet again, it could be me, however I think that wishing harm upon a person prior to their conviction, especially when you do not have all the details, is not only a foolish waste of time, but more so a poor reflection of your process.
Sure, I am not a fan of Palin. However, what occurred was wrong. If Kernell is responsible for it, I am sure he will be held accountable for it. If he is not held accountable for this, and he is indeed the one who perpetrated it, I would say there are larger issues at hand.
Yes, be angry, be upset, this is something to not be pleased about. However, do take this time to re-evaluate your own security. Make sure this does not happen to you.
As for the media… feh. Since when have they been a reliable source of information ? No offense, but everything I have read here sounds like a bunch of bitter individuals commiserating in their own pity.
I would hope I am wrong about all of this, especially where it concerns everyone here.

It’s interesting that the extreme leftist Kernell would have the ONLY constitutionalist from either party that ran for president, Ron Paul, as one of his interest groups.
This, of course, is one place where the Frank’s are actually MORE liberal than they’d admit. The fact is that the guy they supported, Fred Thompson, was far, far to the left of Paul in every area. Probably the reason that Kernell had Ron Paul up was that Ron Paul was perceived as “anti-war”. Actually, Paul is pro-constitution which makes him anti non-declared by Congress “wars”. Ron Paul would be the best defender of the country but would NOT get the country involved in unconstitutional police actions as would Obama, McCain or Fred!!
As a UT Student and staff member I insist that Kernell be totally investigated and prosecuted to the FULL extent of the law if found guilty of illegal activities. I’m not familiar with Yahoo password reset protocol but when changing a password don’t you have to have access to the e-mail account in order to follow the prompts back to change the password?
So there may have been a little more “hacking with intent” and a little less “unplanned and probably spur of the moment”

I earned broadcast and journalism degrees years ago, and (for a while) the managing editor in a broadcast newsroom, and always tended to believe that journalism was a noble field. Now the different standards are obvious. AP says it is OK to spread the contents of a stolen email account across the media world, including the cell phone number of an innocent 17 year old; and then you think it is OK to remove the cell phone number of the offender (suspected) from a publicly posted Facebook page. I don’t get it, and I probably wouldn’t believe your explanation even if you had one.

A Grand Jury in Chattanooga on Tuesday morning heard testimony into the alleged hacking of the personal e-mail of Vice Presidential candidate Sarah Palin.
At 9:00 AM two males and a female, are apparently friends of a University of Tennessee student who is under investigation for the hacking (David Kernell ) entered the Courthouse & testified. (These were the ones in his apartment when the search warrant was served)
Security officers notified members of the media at 10:30 a.m. that the trio had exited the courthouse by another door.
The Grand Jury was expected to make its return later today or Wednesday.
Where ever you are, thought you would want to know. Things are moving pretty fast.

A federal Grand Jury in Chattanooga has declined to indict UT student David Kernell of a felony today.
He was accused of intruding into vice presidential candidate Sarah Palin’s private e-mail.
The grand jury ended its session without sending an indictment against Kernell.
According to a newspaper report. (Chattanooga Times Free Press)
Readers Note- If the law as applied to this case only calls for a misdomener charge, a No Bill would be correct.

In the exchange over 4chan he admitted he did it to get the goods on her. And expressed disappointment that there was nothing there except personel stuff. He admits on his face page that he is an Obama supporter.
He was trying to help elect BO.
Now he has probably decided to be nice and cooperate fully with the prosecution, and I suspect they have offered a lesser charge (misdomener) if he tells all.
I am convinced that Palin smear campaign is orchistrated from the top of the Obama campaign. There is real evidence of that, and it is growing.
If there is a connection between Netroots and David this could be interesting.

Some of you act like this is no big deal but I think it is huge. If someone were to break into my email box, I would feel so violated. To post it on the internet…even worse…but doing this to a potential VP in the middle of a presidential campaign…you have to throw the book at him. He should get the maximum penalty for this because it was not just some private citizen he was doing it to. He was trying to manipulate a national election. This should concern people no matter which party you are adhere to and it definitely should of concern to the “Feds”. Do you want this type of thing to influence the elections in our country? Do you want to encourage this behavior in the future? It is right along the same lines as Watergate and the Clinton’s FBI Files Scandal…It is all very serious because the information they find can be used for blackmailing our lawmakers, or coercing people to vote a certain way on a bill or in this case, potentially affect an election, all very serious things. Everyone no matter the party should take these things very seriously and the penalty for this young man, no matter how naive his motives or judgment has to be the strictest possible to deter people in the future.
