Fox News Reporting That David Kernell Has Been Indicted…

Kernell, the self-described “Obamacrat”, has a very high powered attorney from Knoxville. You can read about him here. Here are Kernell’s facebook pages on an older post…
And a Friday story quotes a past teacher of Kernell’s as saying that he’s done this before as a young lad…

When he heard the name connected to the story – the one about the college kid who allegedly “hacked” his way into a personal e-mail account for Republican vice presidential candidate Gov. Sarah Palin – Tracey McDaniels was not surprised.
There was, after all, a history there.
“He did the same kind of thing when he went to school here,” said McDaniels, a history teacher at Eastern Hills Middle School. “He and another kid found a way to get onto the school’s server – they just sat down and figured out the password.”

UPDATE: WBIR is reporting that Kernell was shackled and cuffed and has provisions with his release:
When he arrived at court, he was shackled and handcufffed.
The conditions for his release contain more than a dozen provisions, including:
–cannot leave the Eastern District of Tennessee without court permission. Kernell’s family lives in Memphis.
–cannot possess a computer.
–can access e-mail and can only access internet for class work.
–must not have any contact with Gov. Sarah Palin or her family.

Good news. I can appreciate that “yutes” make mistakes, but one of these techno-geeks needs to be the example for what happens when you go too far. Upon conviction give him the max!

He pleaded “Not Guilty” wish I had the details of the charges.
The only explanation I can imagine is there is a technical reason the charges do not match what he did. It looked self confessed to me.
“Could go to trial Dec. 16″ (after the election.) Convenient.
Recent events show that these are frightening times we are living in. Are we in the midst of a coup?

Pleading guilty is the norm in cases like this. The defense does not even have any of the evidence against the suspect yet. No discovery. No analysis of the various constitutional issues, plus how much can a lawyer charge if he helps put the noose around his client’s neck on the first day? Lol

David Kernell’s trial date has been changed.
Magistrate Judge Clifford Shirley set a new trial date of May 19 for David C. Kernell.
The trial will be before U.S. District Judge Thomas Phillips.
